These Terms of Service (“Terms”) govern your access to and use of the TradeTalkerAI website, desktop software, customer account, AI-powered analysis features, scanners, reports, educational features, and related products and services (collectively, the “Service”).

By creating an account, purchasing or using credits, purchasing a subscription, downloading or using the TradeTalkerAI software, or otherwise accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

Eligibility

You must be at least 18 years old to create an account, purchase a subscription or credits, or use the TradeTalkerAI software or trading-analysis features.

By using the Service, you represent that you are legally capable of entering into these Terms and that your use of the Service is permitted under applicable law.

Description of the Service

TradeTalkerAI provides software, educational tools, market information, scanners, reports, and artificial-intelligence-powered analysis relating to securities, trading, charts, and financial markets.

Features may include chart analysis, spoken or written AI-generated analysis, market scanners, reports, educational explanations, trading concepts, setup evaluations, technical analysis, and other informational or analytical tools.

Available features may vary according to your account status, subscription, credit balance, software version, promotional access, or other eligibility requirements.

TradeTalkerAI may add, modify, replace, suspend, or discontinue features as the Service evolves.

Educational and Informational Purposes Only

TradeTalkerAI is provided solely for informational, analytical, and educational purposes.

TradeTalkerAI is not a broker, dealer, investment adviser, financial adviser, commodity trading adviser, bank, fiduciary, tax adviser, or legal adviser.

Nothing provided through the Service constitutes personalized investment advice, a recommendation to buy or sell a security, a solicitation to enter into a transaction, or a guarantee that any particular investment or trading strategy is appropriate for you.

References to potential entries, exits, stops, targets, trends, setups, risk/reward ratios, market conditions, or similar trading concepts are analytical or educational observations generated by the Service. They are not instructions to execute a trade.

Trading Risk

Trading and investing involve substantial risk.

You can lose some or all of the money you invest or trade. Short-term trading, active trading, and other speculative strategies may involve particularly significant risk.

Market conditions can change rapidly. Prices, volume, liquidity, volatility, news, trading halts, spreads, execution prices, and other conditions can change between the time TradeTalkerAI performs an analysis and the time you review or act upon it.

TradeTalkerAI does not guarantee profits, successful trades, investment performance, particular outcomes, or the avoidance of losses.

Past performance, simulated performance, historical analysis, scanner results, hypothetical results, or previous successful analyses are not guarantees of future performance.

You should consider your own financial circumstances, objectives, experience, and risk tolerance and, when appropriate, consult a qualified financial professional before making financial decisions.

Artificial Intelligence and Analysis Limitations

TradeTalkerAI uses artificial intelligence and automated systems.

Artificial intelligence can make mistakes.

TradeTalkerAI analysis may be inaccurate, incomplete, delayed, inconsistent, outdated, misunderstood, or based on incomplete information. The Service may incorrectly interpret a chart, ticker, indicator, price, timeframe, technical pattern, market condition, screenshot, or other information.

AI-generated responses may occasionally contain incorrect statements or conclusions that appear confident or plausible.

You should independently verify information that could affect a trading or investment decision.

TradeTalkerAI should be used as an analytical and educational assistant and not as a substitute for your own judgment.

Market Data and Time-Sensitive Information

Financial markets can move rapidly.

Information displayed or analyzed by TradeTalkerAI may not reflect current market conditions by the time you receive or review an analysis.

Quotes, charts, screenshots, market data, news, technical indicators, and other information may originate from third-party platforms or data providers and may be delayed, incomplete, unavailable, or inaccurate.

TradeTalkerAI does not guarantee that market information is real-time, complete, accurate, or suitable for executing trades.

Always verify important market information through an appropriate brokerage platform, exchange, market-data provider, or other authoritative source before acting upon it.

Scanners, Reports, and Identified Opportunities

TradeTalkerAI may provide scanners, reports, watchlists, rankings, grades, setup evaluations, potential entries, stops, targets, risk/reward calculations, or other automated market observations.

Appearance of a security in a scanner, report, watchlist, analysis, or other TradeTalkerAI feature does not constitute a recommendation to purchase or sell that security.

Scanner and report results may change quickly and may become outdated soon after they are generated.

TradeTalkerAI does not guarantee that a security identified by a scanner or report will reach a stated target, remain within an identified setup, or produce a profitable trade.

Educational and Teaching Features

TradeTalkerAI may provide enhanced educational or teaching features designed to explain trading terminology, technical indicators, chart patterns, analytical reasoning, risk concepts, or other market-related subjects.

Educational explanations are intended to help users better understand trading and market analysis. They do not constitute professional financial education, certification, individualized investment advice, or a recommendation to enter into a particular transaction.

Teaching or educational features do not reduce the risks associated with trading or investing.

Users remain responsible for independently evaluating information and determining whether and how to use it.

Customer Accounts

Certain features require a TradeTalkerAI customer account.

You are responsible for providing accurate account information and maintaining the security of your login credentials.

You may not knowingly allow unauthorized persons to use your account or credentials.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

TradeTalkerAI may use account identifiers, device information, or other reasonable security measures to protect accounts, enforce applicable device limits, prevent unauthorized sharing, and detect fraud or abuse.

If you believe your account has been compromised, contact TradeTalkerAI promptly.

Subscriptions

TradeTalkerAI may offer recurring subscription plans.

The price, included credits, billing frequency, and other material terms of a subscription will be disclosed on the applicable pricing, purchase, or checkout page.

Unless otherwise stated at purchase, recurring subscriptions automatically renew at the applicable billing interval until canceled.

You may cancel a subscription through the available account or subscription-management functionality.

Cancellation prevents future recurring charges but does not ordinarily reverse a charge already properly incurred or guarantee a refund for a billing period that has already begun.

Access, credits, or other benefits associated with a canceled subscription may continue through the applicable paid or eligibility period, depending on the terms of the plan.

Credits and Credit Top-Ups

Certain TradeTalkerAI features consume credits.

Credits are units used to access eligible TradeTalkerAI functionality. Credits have no cash value, are not currency, and cannot be redeemed for cash.

TradeTalkerAI may offer credits through subscriptions, separate top-up purchases, promotions, trials, or other programs.

Different types of credits may have different expiration periods or conditions. Applicable expiration terms will be disclosed through the Service, purchase process, account information, promotional offer, or other applicable communication.

Purchased top-up credits may provide eligible customer access to protected TradeTalkerAI features and content while those credits remain valid and unexpired, subject to these Terms.

When no active subscription, valid unexpired top-up credits, promotional eligibility, or other applicable entitlement remains, access to protected features or content may be suspended until eligibility is restored.

Expiration of credits does not automatically delete your TradeTalkerAI account.

Unless otherwise required by law or expressly stated in an applicable offer, unused expired credits are forfeited and are not redeemable for cash.

Promotional and Free Credits

TradeTalkerAI may provide free, trial, bonus, or promotional credits.

Promotional credits may be subject to expiration dates, eligibility restrictions, usage limitations, or other conditions.

Promotional credits have no cash value and are not refundable or transferable.

TradeTalkerAI may modify or discontinue promotional programs and may revoke promotional credits obtained through fraud, abuse, duplicate accounts, manipulation, or violation of promotional terms.

Expiration or exhaustion of promotional credits may result in loss of access to features that require an active subscription, purchased credits, or another valid entitlement.

Credit Usage

The number of credits required for a particular function may vary depending on the feature, analysis mode, processing requirements, or other factors.

Applicable credit usage may change as TradeTalkerAI develops or modifies its Services.

Credits used to process a valid request are generally considered consumed once processing has occurred, even if the user ultimately decides not to rely upon the resulting analysis.

TradeTalkerAI may, at its discretion, restore credits when a request fails because of a confirmed technical problem within the TradeTalkerAI Service.

Payments

Payments may be processed by third-party payment providers such as Stripe.

By submitting a purchase, you authorize the applicable payment provider to charge the payment method you provide for the amount and, for recurring subscriptions, at the applicable recurring interval until cancellation.

You are responsible for applicable charges, taxes, and fees associated with your purchases.

TradeTalkerAI does not guarantee that every payment method will remain available.

Refunds

Except where otherwise expressly stated at the time of purchase or required by applicable law, purchases are generally non-refundable after the applicable Service, subscription period, or credits have been provided.

TradeTalkerAI does not provide refunds because a trade was unsuccessful, an investment lost value, an analysis did not produce the expected result, a security failed to reach a target, or a user did not achieve anticipated trading results.

Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

If you believe you were charged incorrectly or experienced a billing problem, contact TradeTalkerAI support.

Account Expiration, Cancellation, and Reactivation

Cancellation of a subscription, expiration of credits, or loss of active customer status does not automatically delete your TradeTalkerAI account.

Your account may remain available so that you can purchase additional credits, reactivate a subscription, access eligible account information, or obtain customer support.

When an account no longer has an active subscription, valid unexpired top-up credits, promotional access, or another qualifying entitlement, TradeTalkerAI may restrict access to protected website content, reports, software functionality, or other customer-only features.

Eligible access may be restored when the account again satisfies applicable subscription, credit, or entitlement requirements.

Information associated with inactive accounts is handled according to the TradeTalkerAI Privacy Policy.

Software License

Subject to these Terms and applicable account eligibility, TradeTalkerAI grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the TradeTalkerAI software for your own lawful personal use.

You do not acquire ownership of the software or underlying technology.

Unless expressly authorized by TradeTalkerAI, you may not sell, rent, lease, sublicense, distribute, copy, modify, reverse engineer, decompile, attempt to extract source code, circumvent technical protections, or create derivative works from the software.

You may not use TradeTalkerAI software, credentials, credits, or account access to operate an unauthorized commercial service for third parties.

Devices and Access Controls

TradeTalkerAI may limit the number of devices associated with or simultaneously using an account.

Device limits and access-control policies may change as necessary to protect the Service, prevent account sharing, combat fraud, or accommodate legitimate customer needs.

Attempting to circumvent device restrictions, account controls, credit systems, authentication mechanisms, membership protections, or other technical limitations may result in suspension or termination.

Prohibited Uses

You agree not to:

Use the Service for unlawful or fraudulent purposes.
Attempt to gain unauthorized access to TradeTalkerAI systems, accounts, databases, APIs, or infrastructure.
Circumvent authentication, subscriptions, credits, device limits, access restrictions, or security controls.
Share, sell, rent, transfer, or commercially exploit account access without authorization.
Scrape, harvest, systematically extract, or reproduce substantial portions of TradeTalkerAI content or data without permission.
Reverse engineer, decompile, modify, or attempt to obtain source code except where such restrictions are prohibited by law.
Interfere with, overload, damage, attack, or disrupt the Service.
Use automated systems in a manner that places unreasonable loads on TradeTalkerAI infrastructure.
Use the Service to violate another person’s intellectual-property, privacy, or other legal rights.
Misrepresent TradeTalkerAI analysis as guaranteed financial advice or guaranteed trading results.
Use TradeTalkerAI content or output in a deceptive, fraudulent, or unlawful manner.

TradeTalkerAI may investigate suspected violations and take reasonable action to protect the Service and its users.

No Authorization to Execute Trades

Unless TradeTalkerAI expressly introduces a separate feature and separate terms stating otherwise, TradeTalkerAI does not execute securities transactions on your behalf.

TradeTalkerAI does not have authority over your brokerage account and does not instruct your broker to purchase or sell securities.

You are responsible for reviewing and manually deciding whether to act upon information produced by the Service.

Do not provide TradeTalkerAI with brokerage passwords, banking passwords, or other financial-account login credentials.

Third-Party Services

TradeTalkerAI relies on third-party services and technology that may include artificial-intelligence providers, cloud infrastructure, payment processors, email providers, market-data sources, hosting providers, operating systems, charting platforms, brokerage platforms, and other services.

TradeTalkerAI does not control the availability or performance of independent third-party services.

Interruptions, changes, restrictions, errors, outages, or discontinuation of a third-party service may affect TradeTalkerAI functionality.

References or links to third-party products, companies, websites, brokers, securities, or services do not constitute endorsement unless expressly stated.

Service Availability

TradeTalkerAI attempts to provide reliable service but does not guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of maintenance, upgrades, internet problems, software errors, third-party outages, market-data problems, cybersecurity events, capacity limitations, or circumstances beyond our reasonable control.

Trading opportunities can be time-sensitive. You should not rely upon TradeTalkerAI as your sole source of market information or as an emergency or fail-safe trading system.

TradeTalkerAI is not responsible for missed trades or opportunities resulting from Service interruptions, delays, or technical problems, subject to applicable law.

Updates and Changes to the Service

TradeTalkerAI is an evolving product.

We may update software, AI models, prompts, analysis methods, features, interfaces, credit requirements, scanners, reports, supported platforms, technical requirements, or other aspects of the Service.

We may require software updates for continued access to some features.

Features described on the website or previously available are not guaranteed to remain available indefinitely.

Intellectual Property

TradeTalkerAI and its software, website, branding, logos, designs, reports, scanner formats, graphics, text, audiovisual material, documentation, and other proprietary content are owned by or licensed to TradeTalkerAI and are protected by applicable intellectual-property laws.

TradeTalkerAI™, associated branding, and related identifiers may not be used in a manner that suggests endorsement, affiliation, or authorization without permission.

Except for the limited rights expressly granted by these Terms, no intellectual-property rights are transferred to you.

User-Submitted Material

You retain ownership of material that you submit to TradeTalkerAI to the extent you have ownership rights in that material.

You grant TradeTalkerAI the limited rights reasonably necessary to process submitted material, provide the requested Service, operate and secure the system, and otherwise handle the material as described in the Privacy Policy.

You are responsible for ensuring that you have the right to submit material to the Service.

Do not submit unnecessary confidential, personal, or sensitive information in screenshots or analysis requests.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TRADETALKERAI MAKES NO GUARANTEE OR WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, COMPLETE, TIMELY, SECURE, OR SUITABLE FOR ANY PARTICULAR TRADING OR INVESTMENT PURPOSE.

TRADETALKERAI DOES NOT WARRANT OR GUARANTEE ANY INVESTMENT RESULT, TRADING RESULT, PROFIT, RETURN, TARGET PRICE, MARKET PREDICTION, OR ANALYSIS RESULT.

Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADETALKERAI AND ITS OWNERS, AFFILIATES, SERVICE PROVIDERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO USE OF OR INABILITY TO USE THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, TRADING LOSSES, INVESTMENT LOSSES, LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, BUSINESS INTERRUPTION, OR LOSSES ARISING FROM AI ERRORS, MARKET MOVEMENTS, DELAYED INFORMATION, TECHNICAL FAILURES, OR THIRD-PARTY SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADETALKERAI’S TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO TRADETALKERAI FOR THE SERVICE DURING THE SIX MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless TradeTalkerAI and its owners, affiliates, officers, employees, contractors, and agents from claims, damages, liabilities, costs, and expenses arising from your unlawful use of the Service, your material violation of these Terms, or your infringement of another person’s rights.

Suspension and Termination

TradeTalkerAI may suspend or terminate access when reasonably necessary because of fraud, abuse, unauthorized account sharing, security concerns, nonpayment, attempts to circumvent technical controls, material violations of these Terms, unlawful activity, or conduct that threatens the Service or other users.

Where reasonable under the circumstances, TradeTalkerAI may provide notice or an opportunity to resolve the issue.

Termination or suspension does not eliminate payment obligations or other provisions that by their nature should survive termination.

Privacy

Use of the Service is also subject to the TradeTalkerAI Privacy Policy.

The Privacy Policy explains how TradeTalkerAI collects, uses, processes, retains, and protects information associated with the Service.

Changes to These Terms
